TselevPOS Terms of Service

1. Introduction

a) Welcome to TselevPOS! These terms and conditions ("Terms") form a binding legal agreement between you and TselevPOS and govern your access to and use of our software, WhatsApp integration services, payment processing features, support services, and all other related offerings (collectively, the "Services").

b) By accessing or using the Services, we assume you accept these Terms in full. Do not continue to use TselevPOS if you do not agree to all of the terms and conditions stated on this page.

Electronic Acceptance

By creating an account, clicking "Accept," or using any part of TselevPOS, you agree to be bound by these Terms electronically.

2. License

a) Unless otherwise stated, TselevPOS and/or its licensors own the intellectual property rights for all material on TselevPOS. All intellectual property rights are reserved. You may access this from TselevPOS for your own personal use subjected to restrictions set in these terms and conditions.

b) You are specifically restricted from all of the following:

• Republishing material from TselevPOS;
• Selling, renting, or sub-licensing material from TselevPOS;
• Reproducing, duplicating, or copying material from TselevPOS;
• Redistributing content from TselevPOS;
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the software;
• Modifying or creating derivative works of the Services.

3. User Accounts

a) To use our Services, you must be at least 18 years old or have the legal capacity to enter into a binding agreement in your jurisdiction. By creating an account, you represent and warrant that you meet these requirements.

b) You are responsible for maintaining the security of your account and for all activities that occur under the account. You must immediately notify TselevPOS of any unauthorized uses of your account or any other breaches of security.

c) Account sharing is strictly prohibited. Each account is for the sole use of the registered individual or business entity. You may not sell, trade, or otherwise transfer your account to another party.

d) TselevPOS will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

4. WhatsApp Business Integration

1. Purpose of Integration

TselevPOS is a software-as-a-service platform that enables each business to connect its own WhatsApp Business account through the official WhatsApp Business Platform provided by Meta. The integration is currently designed only to send electronic receipts triggered by successful customer transactions and sent on behalf of the connected business.

2. Official Meta Integration

This WhatsApp functionality uses, or is being rebuilt to use exclusively, Meta's officially supported WhatsApp Business Platform APIs and onboarding flows. TselevPOS does not permit the use of unofficial, scraping-based, automated, or unauthorized WhatsApp services. All WhatsApp-related activity remains subject to Meta's platform policies, WhatsApp Business messaging rules, and applicable law.

3. No Unauthorized Data Access

TselevPOS does not access, read, store, or monitor private WhatsApp messages, contact lists, or personal WhatsApp account data. The platform only processes the minimum information required to deliver a customer-authorized electronic receipt initiated by the connected business.

4. How the Integration Works

• Business Onboarding: A business user connects their own WhatsApp Business number through TselevPOS using Meta's official flow.
• Customer Consent: Before any receipt is sent, the business must obtain the customer's explicit consent to receive that receipt on WhatsApp.
• Message Trigger: Once consent is obtained, the receipt is triggered by a successfully completed transaction.
• Security: Messages are delivered using WhatsApp's security controls.

5. Permitted Message Types

WhatsApp messaging via TselevPOS is currently limited to customer-authorized electronic receipts that are directly related to completed transactions. Promotional, marketing, broadcast, cold outreach, bulk messaging, and unrelated follow-up messaging are not supported through this integration.

6. Compliance & Responsibility

• Businesses using WhatsApp through TselevPOS are solely responsible for complying with WhatsApp Business Platform Policies, data protection laws, and consent requirements.
• TselevPOS reserves the right to suspend or restrict WhatsApp integration for any business account that violates platform policies, engages in spam, or creates risk.
• Message delivery and throughput limits are governed by WhatsApp and Meta. TselevPOS does not guarantee uninterrupted service or message delivery.

5. Payments

TselevPOS provides subscription-based software services. All payments for subscriptions and renewals are securely processed through our primary payment gateway, Pesapal. Use of our Services is also subject to the Pesapal Terms and Conditions .

Supported Payment Methods

• Mobile Money: Available in supported countries via Pesapal, including MTN and Airtel. Mobile money fees and charges may apply.
• Credit & Debit Cards: Visa, MasterCard, American Express, and other networks supported by Pesapal.

Fraudulent Payments & Abuse

TselevPOS takes payment security and fraud prevention seriously. Any attempt to use unauthorized, stolen, fraudulent, or unlawfully obtained payment methods is strictly prohibited. We reserve the right to immediately freeze or terminate accounts associated with suspected fraudulent activity.

Refunds

Refunds are subject to TselevPOS’s Refund Policy. By submitting a refund request, you acknowledge and agree that the associated subscription will be immediately terminated and access to all features revoked.

Eligible paid-plan upgrades may separately qualify for unused-time subscription credit as described in the Refund Policy. Approved cash refunds under the 30-day guarantee are calculated from the remaining unused portion of the eligible subscription period and may be subject to a 10% service fee together with any applicable non-refundable third-party or currency conversion fees.

6. Termination

TselevPOS reserves the right, at its sole discretion, to suspend, restrict, or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to violation of these Terms.

Upon submission of an account deletion request, the account will enter a 30-day grace period. During this time, the user may cancel the deletion request. Once the grace period expires, the account and all associated data may be permanently deleted.

7. Limitation of Liability

To the fullest extent permitted by applicable law, TselevPOS, its directors, employees, or partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses arising from your use of the Services.

8. Changes to Terms

TselevPOS reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

9. Fair Use & Abuse Prevention

TselevPOS is intended for legitimate business use. Any attempt to exploit system features, including but not limited to refund abuse, excessive trial cycling, payment manipulation, or service misuse, may result in immediate suspension or termination without refund.

10. Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy .

11. Force Majeure

TselevPOS shall not be liable for any failure to perform its obligations where such failure results from any cause beyond TselevPOS's reasonable control, including natural disasters, war, terrorism, network outages, or government acts.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes shall be subject to the exclusive jurisdiction of Ugandan courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, such provision shall be deleted without affecting the remaining provisions herein.

14. Policy Precedence

In the event of any conflict between these Terms of Service (or the Refund Policy) and any promotional materials or marketing content, the terms of these Terms of Service and the Refund Policy shall prevail.
